Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Ink Therapy HQ mobile application and the inktherapyhq.net website (together, the “Service”) operated by Ink Therapy HQ (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By using the Service you confirm that you meet this requirement.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@inktherapyhq.net if you suspect unauthorized use.

3. The role of Ink Therapy HQ

Ink Therapy HQ is a platform that connects tattoo clients with tattoo artists and studios. We are not a party to any consult, appointment, or tattoo service arranged between users. We do not employ artists, we do not provide tattoo services, and we do not collect payment on their behalf. Any agreement for tattoo work is between the client and the artist or studio.

4. User content

You retain ownership of the content you post (images, text, portfolio work, messages). By posting content to the Service, you grant Ink Therapy HQ a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content within the Service for the purpose of operating it.

You may not post content that is unlawful, infringing, sexually explicit, hateful, harassing, or otherwise violates the rights of others. We may remove content or suspend accounts that violate these Terms.

6. Artist subscriptions

The artist side of the Service requires a paid subscription. Artist subscriptions are billed through Apple App Store or Google Play and are subject to those stores’ terms. Subscriptions renew automatically unless cancelled in your App Store or Google Play account settings before the renewal date. Refunds are handled by the app store you purchased through.

7. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied. We do not warrant the quality, safety, or legality of any tattoo services offered through the Service. We do not guarantee that the Service will be uninterrupted or error-free.

8. Limitation of liability

To the maximum extent permitted by law, Ink Therapy HQ and its officers, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service. Our total aggregate liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) one hundred U.S. dollars (US$100).

9. Indemnification

You agree to indemnify and hold harmless Ink Therapy HQ from any claim, loss, or expense (including reasonable attorneys’ fees) arising from your use of the Service, your content, or your violation of these Terms.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may stop using the Service and request deletion of your account at any time.

11. Governing law

These Terms are governed by the laws of the United States and the state in which Ink Therapy HQ is organized, without regard to its conflict of laws principles. Any dispute will be resolved in the state or federal courts located in that state.

12. Changes to these Terms

We may modify these Terms from time to time. The updated Terms will be posted here with a new “last updated” date. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
